In early August, Kabila’s legal team filed a 16-page complaint with a US federal court seeking to overturn his designation on the Office of Foreign Assets Control (OFAC) sanctions list. The Treasury Department’s enforcement arm placed him on the blacklist, citing alleged ties to the M23 and AFC. His attorneys argue the accusations lack concrete evidence and are based on vague and arbitrary claims.

Denials of financial and military support

Washington accuses Kabila of funding the AFC, a coalition where the M23 is the dominant faction. Additional allegations include encouraging Congolese soldiers to defect and visiting Goma, in eastern DRC, under M23 protection. Kabila’s defense team counters that no financial transactions linked to the AFC have been identified in the US case file. They also point out that no named soldier has been cited as being persuaded to desert due to Kabila’s influence. Furthermore, they highlight that during his presidency in 2013, the DRC military successfully defeated the M23, undermining claims of current support.

The lawsuit emphasizes the absence of tangible proof tying Kabila to the alleged activities. His legal representatives argue that Washington’s sanctions rely on unsubstantiated claims rather than documented evidence. They demand that US authorities present clear, verifiable facts to justify the restrictions imposed on their client.

Kabila, who led the DRC from 2001 to 2019, is now seeking judicial intervention to lift the sanctions and remove his name from the OFAC list.
