The Dakar Criminal Court has once again deferred its ruling in the high-profile case involving the alleged falsification of opposition leader Ousmane Sonko’s signature. The initial verdict, scheduled for July 9, 2026, was postponed for the second time, with the new hearing date set for July 23. The judge cited the absence of another key figure in the proceedings—Chérif Zeyni Abidin Sy—as the reason for the delay.

The court had previously adjourned the case in June to secure the presence of this alleged accomplice, who was not present during earlier sessions. His testimony is now deemed essential before the tribunal can finalize its decision.

Prosecutors seek to keep Khardiata Tandian behind bars

Despite the repeated delays, Khardiata Tandian remains incarcerated as the legal battle drags on. Her legal team seized the opportunity of the latest postponement to file a motion for provisional release, arguing that their client no longer poses a flight risk or threat to witnesses. They also pointed out that:

• All procedural documents have already been submitted to the court.
• Khardiata Tandian has already been questioned by the tribunal.
• She has spent over a year in pre-trial detention—a period her defense claims could cover any potential sentence she might receive.
• Her incarceration is increasingly straining her family situation, as she is a married mother of a young child.

The prosecution opposes her release

The public prosecutor’s office strongly objected, arguing that granting provisional freedom would constitute a public order disturbance. They further claimed that Khardiata Tandian does not provide sufficient guarantees to ensure her appearance in court until the conclusion of the trial. The judges ultimately sided with the prosecution, rejecting the defense’s request and ordering her continued detention.

The case now hinges on the arrival of the second defendant

The tribunal has made it clear that no final verdict will be delivered until Chérif Zeyni Abidin Sy is present in court. His absence had already derailed the initial July 9 hearing, and the latest postponement underscores the judicial system’s insistence on hearing all parties involved before rendering a decision. Barring any additional unforeseen circumstances, Khardiata Tandian’s fate will be sealed on July 23, 2026.

Until then, she remains behind bars, her plea for temporary freedom denied in favor of maintaining judicial rigor.
